Fair compensation

We are committed to representing and defending the rights of clients, individuals and businesses, who have suffered unjustified delays in court proceedings, working to obtain appropriate compensation in accordance with current regulations.

The Pinto Law, officially known as Law March 24, 2001, no. 89, is an Italian regulation that aims to guarantee fair compensation in cases of excessive duration of judicial proceedings.

This standard incorporated the European principle of the “Convention for the Protection of Human Rights and Fundamental Freedoms,” which states verbatim, “Everyone has the right to have his or her case heard fairly, publicly and within a reasonable time.”

Based on the so-called. Pinto Law, as amended, it is possible to bring Appeal (ex Pinto) when the proceedings exceed a reasonable length of time, estimated by the legislature as: – 3 years for first-instance proceedings or – 2 years for second-instance proceedings or – 1 year for cassation regardless of the outcome of the litigation and/or in case of conciliation of the litigation.

Main areas:

  1. Legal advice: we provide an initial assessment of the feasibility of seeking fair compensation for clients who believe they have been harmed by protracted legal proceedings.
  2. Case analysis: In-depth examination of clients’ cases to determine whether the basis for claiming fair compensation under the Pinto Law exists. This may involve assessing the length of court proceedings, documenting the causes of delay, and quantifying the damage suffered.
  3. Submission of claims: Preparation and submission of claims for fair compensation to the relevant judicial authorities.
  4. Legal representation: Representation of clients during all stages of legal proceedings aimed at obtaining fair compensation.
